“According to the market research firm Gitnux, studies show that on average, legal disputes are settled within 45 days through mediation, while litigation can take 18 months. The efficiency of the mediation process is apparently no secret to large companies, as 90% of the global Fortune 500 companies currently use ADR services, including mediation.”

“Mediation is a good option for anyone who wishes to preserve a relationship with the other party to the dispute, such as disputes involving family members or business associates,” says Allison Johs, founding member of Mediation Solutions of NY LLC in Islandia. “Unlike litigation, mediation keeps matters private, preserves the relationship between the parties and enables the business to survive.”

The alternative to mediation, which surrenders this power to the court system, doesn’t always lead to more favorable resolutions, explains Johs. “In litigation, the outcome is left up to a judge or jury, who may be constrained by specific laws,” she says. “Mediation provides clients with a means to be heard, to discuss the aspects of the case that are most important to them, and to work with a mediator to develop creative solutions to resolve the dispute.”
